CorbinPartners survey evidence assists Federal Court on TMOB appeal

Consumer survey evidence from CorbinPartners assisted the Federal Court in a judicial review for Bauer Hockey Corp. v. Easton Hockey Canada, Inc. In the decision, Justice Richard Bell determined that affidavit evidence, including an expert report from Dr. Ruth Corbin, “would have materially changed the outcome of the [Trademarks Opposition] Board’s decision, and in light of this evidence, the decision does not meet the standard of correctness.” In turn, Justice Bell reversed the Board’s decision to expunge the Applicant’s trademark from the Trademark Register.
